Terms of Use

1. Provider and Scope

The contractual partner and operator of the service 'Money Koi' is Gerald Gmainer, Am Platzl 3 / 3, 4451 Garsten, Austria (hereinafter 'Provider'). These terms apply to the mobile application Money Koi and all associated services, including the future web version. By creating an account, you agree to these terms.

2. Account, Registration, and Security

• Registration occurs via Email OTP (Magic Link) or Google OAuth. You are responsible for maintaining the confidentiality of your login credentials.
• An account is tied to an individual but can be used across multiple devices owned by that individual.
• Shared use: Currently, a household can be managed via a shared account. Future updates will introduce separate user profiles within a 'tenant' (household).
• The service is intended for users aged 16 and older. Minors may only use the app with the explicit consent of their legal guardians.

3. User Content and Prohibited Conduct

• You retain all rights to the data you enter (bookings, categories, account names).
• Prohibited use: You may not use the app for illegal purposes, upload harmful code, or attempt to scrape/automate data entry in a way that stresses our infrastructure.
• Illegal or misleading content is strictly prohibited. The Provider reserves the right to remove content or suspend accounts that violate these rules.

4. Service Availability and Support

• The service is provided on a 'best effort' basis. While we strive for high uptime, we do not guarantee uninterrupted availability.
• Support is provided voluntarily via email (moneykoi.app@gmail.com). We aim to respond within 3 business days.
• Offline-First: The app stores data locally and syncs with the server when an internet connection is available. The Provider is not liable for data loss resulting from local device failure.

5. Fees and Subscription Model

• Basic Use: The app is currently free of charge and ad-free.
• Future Subscriptions: We plan to introduce a subscription model (approx. €0.99/month). You will be notified in advance and must actively opt-in to any paid services.
• Third-Party Billing: If a subscription is purchased through the Apple App Store or Google Play Store, the payment terms of those platforms apply.

8. Permissible Use and Prohibitions

• Harassment, abuse of services, and bypassing technical protection measures are strictly forbidden.
• Commercial resale or rental of access to the service is not permitted without written consent.

9. Termination and Suspension

• Users may terminate their account at any time via the in-app deletion function. Data is generally deleted within 30 days.
• The Provider may suspend or terminate access without notice in the event of serious violations of these terms.

10. Liability and Warranty

• The Provider is liable for intent and gross negligence. For slight negligence, liability is limited to typical, foreseeable damages.
• The Provider assumes no responsibility for financial decisions made based on the data displayed in the app.

11. Amendments to Terms and Service

• We may update these terms for legal or technical reasons to reflect the evolution of the service.
• Significant changes will be announced at least 14 days before taking effect via the app or email.
• Pure bug fixes, security updates, or changes purely beneficial to the user apply immediately.

12. Applicable Law and Language

• This contract is governed by Austrian law, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods.
• The contract language is German. Any translations are provided for convenience and clarity only.
